By using the website (the “Website”) owned by Broken English, LLC, a California limited liability company (“Company”) and hosted by Shopify Inc (“Shopify”), you signify that you have read, understand and agree to be bound by this Privacy Policy (“Privacy Policy”).

 

What this Privacy Policy Covers

This Privacy Policy applies to all online communication with the Website. When you provide us with online information through the Website, we respect your privacy. It is important for you to understand what information we collect about you during your visit and what we do with that information. Please note that your visit to the Website is subject to this Privacy Policy and the Terms of Use and Conditions of Purchase posted on the Website.

This Privacy Policy does not apply to the activities of the Company’s third party sponsors, advertisers, licensees, affiliates and other partners that may collect your user information while accessing or using such third party’s services in connection with your use of the Website (e.g. social media and sharing services).  The privacy and information practices of those third parties are not covered by this Privacy Policy.  To learn more about such third party policies, we encourage you to read and review the privacy statements of each third party services that you may choose to use in connection with the Website.  This Privacy Policy applies only to information collected by the Company.

Voluntary Submission:  We collect personally identifiable information about you via our Website when you voluntarily provide it in connection with a request for a product, service, or information. You may browse our Website without providing any personal information; however, if for example, you decide to place an order, we will ask you for your name, delivery and billing address, phone number(s), email address, credit card number and its expiration date. If you choose to complete a user registration form, survey or sweepstakes entry form, we may ask you for information such as your contact information (e.g., name, e-mail address and mailing address), age group or birth date. Occasionally, we may also ask you for other information such as gender, income level, and information about your prior experiences with the Company's products. When you submit your personally identifiable information on the Website, you are giving your consent to the collection, use and disclosure of your personal information as set forth in this Privacy Policy.

You verify that any contact information provided to the Company, including, but not limited to, your mailing address, shipping address, e-mail address, residential phone number, and mobile phone number is true and accurate. You further verify that you are the telephone subscriber and/or that you own any telephone numbers that you provide to the Company. You acknowledge that by voluntarily providing your telephone numbers to the Company, you expressly agree to be contacted at the telephone numbers you provide.

Automatic Collection:  We may also collect, store or accumulate certain non-personally identifiable information concerning your use of this Website, such as information regarding which of our pages are most popular, browser, city, time zone, referring URL, and operating system.  Information gathered may be used in aggregate form for internal business purposes, such as generating statistics, developing marketing plans, customizing content, and improving the Website. We may share or transfer such aggregate, non-personally identifiable information with or to our affiliates, licensees and partners.

Correcting/Deleting/Augmenting Your Information:  You can update and/or remove the information you have voluntarily provided to us by logging into your account on the Website.  If you would like a copy of all of your personal information which we have collected, want us to delete all of your information or have questions about updating your information, please write to inquiries@brokenenglishjewelry.com.

 

Use/Disclosure of Personal Information

Overview:  Our primary goal in collecting, using, and sharing user information is to enhance your experience on the Website, support the Website, and improve its features, performance, and other elements.  Your user information may be used for the purposes outlined below.  We will not use your user information without a valid legal basis to do so.

The Company and its affiliates and subsidiaries may use the information that you provide to fulfill your request for a product, information, or other service, or respond to an email or other request, as well as to create and deliver to you our newsletters or surveys, communications containing product information, usage tips or promotions, help improve our Website or services, or customize visitors' experience at our Website. The Company may also make your name, email address, mailing address and/or telephone number available to carefully selected business partners, vendors and other third-party organizations to provide you with information about products, services and special offers we think may interest you or to improve our products, services and advertising. Many of our users find this a valuable and time-saving service.

We want to communicate with you via email correspondence only if you want to hear from us. Log Files:  The Website’s web and ad servers log information about a user’s IP address, browser and the current URL the user is requesting.  This information is always provided by a user’s browser and automatically logged by most websites.  These log files are stored in a secure location and used in our internal analysis of traffic patterns within our site. 

As Necessary to Provide Services to You: We may contract with companies or individuals to provide certain services including email and hosting services, credit card processing, shipping, data management, surveys and marketing, promotional services, to assist in preventing or deterring fraud, etc. We call them our Service Providers. We may share personally identifiable information with Service Providers solely as appropriate for them to perform their functions, but they may not use such information for any other purpose. One of our Service Providers is Google Analytics, which we use to help us learn about who visits our site and what pages are being looked at.

The Website is hosted on Shopify. Shopify provides us with the online e-commerce platform that allows us to sell our products to you.  Your data is stored through Shopify’s data storage, databases and the general Shopify application.  Shopify stores your data on a secure server behind a firewall.  If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. Once you leave our Website are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Website’s Terms of Use and Conditions of Service.

We do not share your credit card information with unaffiliated third parties unless you authorize us to do so, or if it is necessary to fulfill our responsibilities including, but not limited to, delivering a product or service that you order.

As Required By Law; In the Event of a Sale.  Finally, the Company may in its sole discretion disclose personal information in special cases: (1) when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) the rights of the Company or to anyone that could be harmed by such activities; (2) when we believe in good faith that the law requires it; (3) to any third party who may acquire the Company; and (4) in situations involving threats to the physical safety of any person.

You acknowledge that telephone calls to or from the Company may be monitored and recorded and you agree to such monitoring and recording.

 

Technology Utilized; Cookies; Web Beacons. 

Like many e-commerce websites, we employ several commonly used technologies on the Website: cookies, clear gifs, networking traffic monitoring and active scripting. Below is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not:

_session_id, unique token, sessional, allows Shopify to store information about your session (referrer, landing page, etc);

_shopify_visit, no data held, persistent for 30 minutes from the last visit, used by our website provider’s internal stats tracker to record the number of visits;

_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, counts the number of visits to a store by a single customer;

cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart;

_secure_session_id, unique token, sessional;

storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access;

PREF, persistent for a very short period, set by Google and tracks who visits the store and from where;

"Clear gifs" (also known as "web beacons" or “pixel tag”) are tiny graphics with a unique identifier, similar in function to cookies, and are used to help us better optimize our advertising;

"Network traffic monitoring" is programming that monitors and analyzes network traffic, and can be used to capture data being transmitted on a network, including plain-text data and computer IP addresses;

"Active scripting" is programming code that is designed to collect information about your interactions with the Website, such as which links you click on. The code is temporarily downloaded onto your computer or mobile device from our server or a third-party service provider, is active only while you are connected to the Website, and is deactivated or deleted thereafter;

We may combine automatically collected Website usage information with your personal information. In those cases, we will apply this Privacy Policy to the combined information.

 

Ensuring Your Security

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.  If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Privacy of Children:  Our Website is intended for adults. We do not knowingly collect (nor do we wish to collect) personal information from children under the age of 13.  However, if the parent or guardian of a child under 13 believes that the child has provided us with personally identifiable information, the parent or guardian of that child should contact us at info@brokenenglishjewelry.com if they want this information deleted from our files so that it is not in retrievable form.  If we otherwise obtain knowledge that we have personally identifiable information about a child under 13 in retrievable form in our files, we will delete that information from our existing files so that it is not retrievable.

Cross-Border Transfers:  Your user information may be transferred to other countries in connection with your use of the Website.  If you access or use the Website outside of the United States, your user information will be transferred to our servers [in the United States].

 

Do Not Track Signals

Some web browsers offer a “Do Not Track” (“DNT”) signal. A DNT signal is a HTTP header field indicating your preference regarding tracking or cross-site user tracking. Although we are currently unable to honor DNT signals, we do not collect personal information when you visit our Website unless you provide such information to us.
